6. User Obligations and Prohibited Conduct

When using the Service, you agree to comply with all applicable laws and regulations and to refrain from engaging in prohibited conduct. You specifically agree NOT to:

• Use the Service to generate documents that are fraudulent, false, misleading, or intended to deceive others
• Create documents for illegal purposes or to facilitate illegal activities
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
• Violate any intellectual property rights of CreateMyDoc or any third party
• Attempt to gain unauthorized access to the Service, other Accounts, or computer systems or networks connected to the Service
• Use any robot, spider, scraper, or other automated means to access the Service without our express written permission
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service
• Interfere with or disrupt the integrity or performance of the Service or the data contained therein
• Transmit any viruses, malware, or other harmful code through the Service
• Upload, post, or transmit any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Collect or harvest personal information about other users without their consent
• Use the Service in any manner that could damage, disable, overburden, or impair our servers or networks
• Rent, lease, loan, sell, resell, sublicense, distribute, or otherwise transfer the Service or any portion thereof

All rights, title, and interest in and to the Service remain with CreateMyDoc. Nothing in these Terms grants you any right, title, or interest in our intellectual property except as expressly set forth in the license grant below.

User-Generated Content: You retain ownership of any User Content you provide to the Service. However, by submitting User Content, you grant CreateMyDoc a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, process, adapt, and display such User Content solely for the purpose of providing and improving the Service.

Generated Documents: Documents generated through the Service using your inputs are considered your property. However, the underlying structure, formatting, and AI technology used to generate these documents remain the intellectual property of CreateMyDoc.

8. License Grant to Users

Subject to your compliance with these Terms, CreateMyDoc grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal or internal business purposes.

This license does not permit you to:

• Use the Service for commercial document generation services for third parties without our express written consent
• Copy, modify, distribute, sell, or lease any part of the Service
• Create derivative works based on the Service
• Reverse engineer or attempt to extract the source code of the Service

We reserve all rights not expressly granted in these Terms.

9. User Content and Data

You are solely responsible for all User Content you provide to the Service, including its legality, reliability, accuracy, and appropriateness. You represent and warrant that:

• You own or have the necessary rights to provide the User Content
• The User Content does not violate any third-party rights, including intellectual property rights, privacy rights, or contractual rights
• The User Content is not unlawful, fraudulent, defamatory, or otherwise objectionable

We reserve the right, but have no obligation, to monitor, edit, or remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

You acknowledge that User Content may be processed by third-party AI service providers (such as Google Gemini) as part of the document generation process. Please review our Privacy Policy for more information about how your data is handled.

10. Payment Terms

CreateMyDoc currently offers its basic document generation services free of charge. However, we reserve the right to introduce paid features, premium services, or subscription plans in the future.

If and when paid services become available:

• All fees will be clearly disclosed before you make any purchase
• Payment will be processed through secure third-party payment processors
• All fees are non-refundable unless otherwise stated
• You authorize us to charge your payment method for all fees incurred
• Subscription fees may be subject to change with advance notice
• Failure to pay fees may result in suspension or termination of access to paid features

We will provide at least 30 days' notice before implementing any new fees for previously free services, and you will have the opportunity to discontinue use before charges apply.

11. Limitation of Liability

• Loss of data or information
• Business interruption
• Legal fees, court costs, or expenses incurred in litigation
• Damages resulting from your use or inability to use the Service
• Damages resulting from reliance on documents generated through the Service
• Damages arising from errors, omissions, or inaccuracies in generated documents
• Damages arising from unauthorized access to your Account or data

THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE TOTAL AMOUNT YOU PAID TO CREATEMYDOC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR VIRUS-FREE
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT OR DOCUMENTS
• WARRANTIES THAT GENERATED DOCUMENTS WILL MEET YOUR LEGAL REQUIREMENTS OR BE ENFORCEABLE
• WARRANTIES REGARDING THE RESULTS YOU MAY OBTAIN FROM USING THE SERVICE

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM CREATEMYDOC OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

13. Indemnification

You agree to indemnify, defend, and hold harmless CreateMyDoc, its officers, directors, employees, agents, affiliates, contractors, licensors, service providers, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees and court costs) arising from or relating to:

• Your use or misuse of the Service
• Your violation of these Terms or any applicable law or regulation
• Your violation of any third-party rights
• Any User Content you provide or actions you take using the Service
• Your use of or reliance on any documents generated through the Service
• Any breach of your representations and warranties set forth in these Terms

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

14. Dispute Resolution and Arbitration

Informal Resolution: Before filing a formal dispute, you agree to contact us and attempt to resolve any dispute informally. Contact us at support@createmydoc.com with a detailed description of the dispute. We will attempt to resolve the dispute informally within 60 days.

Binding Arbitration: If we cannot resolve the dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.
