Cease and Desist Letter

A Cease and Desist Letter is a formal written demand sent to an individual or business to stop purportedly illegal or infringing activity and not restart it. Common uses include addressing trademark or copyright infringement, harassment, defamation, breach of contract, or violation of non-compete agreements. The letter typically describes the offensive conduct, explains why it's unlawful, demands immediate cessation, and warns of legal action if the conduct continues. While not a legal requirement before filing a lawsuit, cease and desist letters often resolve disputes without litigation and demonstrate that the sender attempted to resolve the matter amicably. The letter should be factual, professional, and specific about what actions must stop. However, sending unfounded or threatening cease and desist letters can itself create legal liability.
