Trademark Registration

Trademark Registration is the process of officially registering a word, phrase, symbol, design, or combination thereof that identifies and distinguishes goods or services. Registration provides legal presumption of ownership and exclusive rights to use the mark nationwide in connection with the specified goods or services. The application requires specifying the mark, identifying the goods/services it will be used with (using approved classifications), providing a specimen showing actual use, and filing fees. The trademark office examines the application for conflicts with existing marks and compliance with trademark law. If approved, the mark is published for opposition, and if no one objects, it proceeds to registration. Trademark rights can last indefinitely as long as the mark is used in commerce and renewal fees are paid. Registration is not required to use a mark, but provides significant legal advantages.
