An Affidavit of Support (Form I-864) is a legally enforceable contract where a sponsor accepts financial responsibility for an immigrant to the United States. Required for most family-based and some employment-based immigrant visas, the affidavit ensures immigrants won't become public charges. The sponsor must: be a US citizen or permanent resident, be at least 18, reside in the US, and meet income requirements (typically 125% of federal poverty guidelines). The affidavit requires: financial information, tax returns, proof of income and assets. If income is insufficient, joint sponsors or household members can provide additional support. The obligation continues until the immigrant becomes a citizen, has 40 qualifying work quarters, permanently leaves the US, or dies. Sponsors can be sued for support and are responsible for repaying any means-tested public benefits the immigrant receives.
